Throughout these Terms of Service, “SHAMI”, “Shami Seafood”, “we”, “us” and “our” refer to Shami Group of Companies Pty Ltd trading as Shami Seafood.
These Terms of Service govern your access to and use of our website, online store, products, services and related features.
By accessing our website, creating an optional customer account or placing an order, you agree to these Terms of Service and the policies referred to in them, including our Shipping Policy, Refund Policy and Privacy Policy.
Please read these Terms carefully before using the website or placing an order. Nothing in these Terms excludes, limits or replaces any consumer rights or remedies that cannot lawfully be excluded under applicable South African law.
Online Store Terms
By using this website, you confirm that you are legally capable of entering into a binding transaction or that you are using the website with the involvement and consent of a parent or legal guardian.
You may not use our website, products or services for any unlawful or unauthorised purpose.
You must not introduce viruses, malicious code or other material that may damage, disrupt or interfere with the website, our systems or another person’s use of the website.
Online-Order Business
SHAMI operates primarily as an online-order seafood business rather than a walk-in retail store.
Orders should be placed through our website or arranged directly with SHAMI where applicable.
Collection from our Kensington location is available by arrangement only. Please wait for confirmation that your order is ready before arriving for collection.
Products and Product Information
We take reasonable care to ensure that product descriptions, images, prices, pack sizes and other information displayed on the website are accurate.
Seafood and other food products may naturally vary in colour, shape, size, appearance, count and texture. Product photographs are intended to provide a reasonable representation but may not show the exact item supplied.
Where a product is sold by an approximate weight, weight range or approximate count, reasonable natural variation may occur.
Packaging may occasionally differ from the packaging displayed online where suppliers change labels, pack formats or branding, provided that the product supplied remains materially consistent with the description.
You are responsible for reviewing the product description, pack size, preparation format, allergens and storage information before purchasing or consuming a product.
Product Availability
All products are subject to availability.
Products displayed as out of stock cannot normally be ordered through the website.
In the unlikely event that an item becomes unavailable after you place an order, we will contact you before fulfilment.
You may choose an approved replacement or receive a refund for the unavailable item. SHAMI will not substitute a product without your approval.
We reserve the right to limit quantities, discontinue products or decline an order where stock is unavailable or where fulfilment is not reasonably possible.
Prices and Promotions
Prices are displayed in South African rand and may change without notice.
The price applicable to your order will normally be the price displayed when the order is placed, subject to correction of a clear pricing or technical error.
If we identify a material pricing error after an order has been submitted, we will contact you before fulfilment. You may accept the corrected price or cancel the affected item or order for a refund.
Discounts, promotions and promotional codes may be subject to additional conditions, including:
- Eligibility requirements
- Minimum order values
- Specified products or collections
- Expiry dates
- Usage limits
- One offer per customer
- Exclusion of certain products or services
Unless expressly stated otherwise, only one discount code may be used per order.
Discount codes cannot be exchanged for cash and may not be applied retrospectively to an order that has already been completed.
Orders and Order Acceptance
Submitting an order does not guarantee that every item can be supplied.
Orders remain subject to:
- Product availability
- Successful payment or an approved payment arrangement
- Accurate customer and delivery information
- Delivery-area eligibility
- Fraud and security checks
- Our ability to prepare and fulfil the order
We may refuse, suspend or cancel an order where:
- A product is unavailable
- A price or product description contains a material error
- Payment cannot be confirmed
- The delivery address falls outside an area we can reasonably service
- The order appears fraudulent, abusive or unauthorised
- The quantity ordered cannot reasonably be fulfilled
- The customer has provided incomplete or inaccurate information
- Fulfilling the order would be unlawful or unsafe
Where we cancel a paid order or item, we will notify you and process the applicable refund.
Customer Information
You must provide complete and accurate information when placing an order, including your:
- Name
- Email address
- Reachable telephone number
- Delivery or collection details
- Billing information, where required
Please notify us as soon as possible if your contact details, delivery address, access instructions or order requirements change.
SHAMI is not responsible for delays or failed delivery resulting from materially incomplete or incorrect information supplied by the customer.
Customer Accounts
A customer account is optional. You do not need to create an account to place an order.
Where you choose to use a customer account, you are responsible for:
- Providing an email address that you are authorised to use
- Protecting access to your email account and authentication codes
- Keeping your profile and contact information current
- Notifying us if you suspect unauthorised account access
We may restrict or suspend account access where reasonably necessary to protect customers, prevent misuse or maintain website security.
Payment
Available payment methods are displayed during checkout and may include Paystack and Cash on Delivery where offered.
Online payment must be successfully confirmed before a prepaid order can be dispatched or released for collection.
Where Cash on Delivery is selected and accepted, the full amount due must be paid when the order is delivered, unless another arrangement has been confirmed by SHAMI.
Payments processed through third-party payment providers are also subject to the provider’s applicable terms and security processes.
SHAMI does not generally receive or store your complete payment-card details.
Order Changes and Cancellations
Please contact SHAMI as soon as possible if you need to change or cancel an order.
We will try to accommodate a request where reasonably possible, but changes or cancellations cannot be guaranteed once:
- Order preparation has started
- A custom preparation service has started
- The order has been packed
- The order has been dispatched
- Collection has been completed
Where an order can be cancelled before preparation or fulfilment begins, any approved refund will be processed to the original payment method.
Where only part of an order can be cancelled, the remaining products and applicable delivery charges may still proceed.
Custom Preparation Services
Certain products may include optional preparation services such as cut-and-devein, filleting, portioning or another agreed preparation request.
You are responsible for selecting or communicating the correct preparation request.
Once custom preparation has started, the affected product or service cannot normally be cancelled or returned for a change of mind.
This does not affect any rights that may apply where the preparation service was performed incorrectly or the product supplied is unsafe, defective or materially different from what was agreed.
Delivery
Delivery areas, fees, estimated timing, delivery hours and important delivery requirements are explained in our Shipping Policy.
Our standard Cape Town delivery fee is displayed during checkout.
Delivery estimates are not guaranteed appointment times. Delivery may be affected by traffic, severe weather, access restrictions, product availability, operational delays or other circumstances outside our reasonable control.
Someone must be available at the delivery address to receive the order.
Due to the perishable nature of our products, drivers cannot leave orders unattended.
SHAMI may decline or postpone a delivery where safe or reasonable delivery cannot be completed. Where possible, an alternative delivery or collection arrangement will be offered.
Unsuccessful Delivery Attempts
If delivery cannot be completed because no one is available, access cannot be obtained, the delivery information is incorrect or the recipient refuses the order, the order may be returned to SHAMI.
We will contact you to arrange collection or another delivery attempt.
An additional delivery fee may apply where redelivery is required. Any additional charge will be confirmed before another delivery is arranged.
Collection and Customer-Appointed Couriers
Collection from our Kensington location is free and available by appointment.
Please wait for confirmation that your order is ready before arriving.
You may arrange your own courier at your expense, provided that collection is coordinated with SHAMI in advance.
You are responsible for ensuring that your appointed courier is suitable for transporting frozen or perishable food products.
Risk associated with transportation by a customer-appointed courier transfers to the customer once the order has been collected and handed to that courier, except where applicable law provides otherwise.
Storage and Food Safety
Frozen products should be transferred to suitable frozen storage as soon as reasonably possible after delivery or collection.
Fresh and chilled products should be refrigerated and used within an appropriate period, taking account of the product label, storage instructions and condition of the product.
Do not consume a product that appears unsafe, damaged, spoiled or materially compromised. Contact SHAMI promptly and retain the product and packaging for assessment.
Customers are responsible for following applicable storage, handling, preparation and cooking instructions after delivery or collection.
Returns, Refunds and Product Problems
Returns, damaged products, incorrect products, refunds and replacements are governed by our Refund Policy.
Please inspect your order promptly after delivery and contact us as soon as reasonably possible if an item is damaged, unsafe, defective, expired or incorrectly supplied.
Nothing in these Terms or our Refund Policy limits any consumer rights that cannot lawfully be excluded.
Marketing Communications
You will receive marketing emails only where you have subscribed or where communication is otherwise permitted under applicable law.
You may unsubscribe using the link in a marketing email.
Unsubscribing from marketing will not prevent us from sending order confirmations, delivery updates, account messages, payment information or other necessary service communications.
Our collection and use of personal information are explained in our Privacy Policy.
Customer Reviews and Submissions
Where you submit a review, photograph, comment, testimonial or other content to SHAMI, you confirm that:
- The submission is based on your genuine experience or is otherwise accurate
- You have the right to provide the content
- The content does not infringe another person’s rights
- The content is not unlawful, threatening, abusive, misleading or defamatory
- The content does not contain malicious code or unauthorised advertising
You grant SHAMI a non-exclusive, royalty-free permission to display, reproduce and use the submission for operating, improving and promoting the business, subject to applicable privacy and consumer law.
We may moderate or remove content that violates these Terms, but we are not required to publish every submission.
Intellectual Property
The website and its content, including logos, branding, text, product descriptions, photographs, graphics, layouts and design elements, are owned by or licensed to SHAMI unless otherwise stated.
You may use the website for personal shopping and informational purposes.
You may not reproduce, distribute, modify, sell, publish, commercially exploit or create derivative works from our website content without prior written permission.
Third-Party Services and Links
Our website may use or link to third-party platforms and services, including ecommerce hosting, payment processing, delivery, analytics, advertising, social media and customer-review services.
Third parties may have their own terms and privacy policies. SHAMI does not control and is not responsible for the independent content, security or practices of third-party websites and services.
A link to a third party does not necessarily constitute an endorsement.
Website Availability and Errors
We aim to keep the website accurate, secure and available, but we do not guarantee that access will always be uninterrupted or error-free.
We may correct errors, update information, temporarily suspend features or perform maintenance where reasonably necessary.
We reserve the right to correct typographical, pricing, product, availability, delivery or technical errors, including after an order has been submitted. Where a correction materially affects an order, we will contact you before fulfilment where reasonably possible.
Prohibited Uses
You may not use the website or its content to:
- Commit or encourage an unlawful act
- Provide false or misleading information
- Impersonate another person
- Interfere with the website’s operation or security
- Upload malware or harmful code
- Attempt unauthorised access to an account, system or data
- Scrape, harvest or misuse personal information
- Send spam or unauthorised advertising
- Infringe intellectual-property, privacy or other legal rights
- Use automated systems in a manner that places an unreasonable burden on the website
We may restrict access or take appropriate action where these Terms are violated.
Limitation of Liability
To the fullest extent permitted by law, SHAMI will not be responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control.
SHAMI is not responsible for loss resulting from:
- Incorrect information provided by the customer
- Improper storage, handling or preparation after delivery or collection
- Delays caused by circumstances outside our reasonable control
- Actions of a customer-appointed courier after collection
- Unauthorised access caused by a customer failing to protect their email account or authentication codes
Nothing in these Terms excludes or limits liability for fraud, gross negligence, unsafe or defective goods, or any other liability or consumer remedy that cannot lawfully be excluded or limited.
Events Outside Our Reasonable Control
We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, including severe weather, road closures, traffic disruption, power or communications failures, supplier disruption, public emergencies, labour disruption, access restrictions or government action.
Where such an event affects your order, we will take reasonable steps to communicate with you and arrange fulfilment, an alternative option or a refund where appropriate.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, website, products, services, legal obligations or operating practices.
The latest version will be published on this page together with the date it was last updated.
Changes will apply from the date they are published and will not retrospectively remove rights relating to an order already completed.
Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as modified or removed only to the extent necessary.
The remaining provisions will continue to apply.
No Waiver
If SHAMI does not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.
Governing Law
These Terms and transactions conducted through the website are governed by the laws of South Africa.
Any dispute will be handled in accordance with applicable South African law and the rights available to consumers through the relevant courts, regulators and dispute-resolution bodies.
